Pennsylvania's New Bicycle Safety Law

Given the current price of fuel, many Americans in larger cities are turning to alternative forms of transportation. Bicycles are a great and relatively inexpensive form of transportation and an effective cardiovascular exercise that strengthens muscles. In addition, it may also be a relaxing hobby to reduce everyday stress.

Bicycling appeals to many different groups of people. Statistics have shown that approximately 85 million Americans ride bicycles at least occasionally. That’s over one fourth of the United States population.

Bicycle Safety and Injuries

Of course, there are safety issues associated with riding a bicycle. Bicycles do not offer the protection that other vehicles offer in the event of an accident. Because of this, bicyclists are encouraged to wear proper safety gear.

Wearing a helmet while riding may seem simple, but it is one of the most effective ways to prevent serious injuries. As many bicycle-related injuries involve trauma to the head, helmets are a necessity. Some research states that wearing a properly designed and fitted helmet can reduce the risk of severe head injuries by 75 to 85 percent.

Head injuries from bicycle accidents can range from minor to severe, but account for over 60 percent of bicycle fatalities of riders ages 19 and under. Many others who suffer head injuries from bicycle accidents face the difficulties of traumatic brain injuries (TBI). Because of this, it is very important to wear a properly designed helmet when riding a bicycle, especially near traffic.

Other common injuries include:

  • Broken and fractured bones
  • Sprains
  • Cuts and bruises
  • Facial damage

In addition to wearing a helmet, other protective gear may be worn to reduce the risk of injuries.

No matter how proficient a person is at riding a bicycle, he or she cannot always account for the actions of other motorists, bicyclists, or pedestrians. Though there are numerous rules and laws for sharing the road with bicyclists, accidents and injuries may occur due to negligence. Being prepared for such unexpected incidents can save a life.

Recently, a new law was introduced in Pennsylvania to help reduce the number of bicycle-related traffic accidents.

Pennsylvania House Bill 170

Pennsylvania House Bill 170 was signed into law on February 2, 2012 by Governor Tom Corbett. This bill was designed to amend Title 75 (Vehicles) in order to improve the safety of bicyclists traveling on Pennsylvania roads. Specifically, House Bill 170 establishes new criteria and rules for sharing the road with bicyclists.

The specific details of how House Bill 170 changed the rules include:

  • Bicycles must be operated in the right hand lane, or as close as practicable to the right hand curb or edge of the roadway.
  • This does not apply to a bicycle using any portion of the road due to unsafe surface conditions.
  • Motorists must overtake a bicycle with no less than four feet between the vehicle and the bicycle and must do so at a prudent speed.
  • No turn by a motorist may interfere with a bicycle proceeding straight.
  • Bicycles must be operated at a safe and reasonable speed.

Pennsylvania drivers and bicyclists should be aware of and adhere to these changes in order to safely share the roads. Though many of these amendments are not radical changes from what is already taught, they are designed to make bicycle travel safer and reduce the risk of traffic collisions.

Pennsylvania lawmakers hope that these amendments will improve the safety of roadways for those who choose this alternative form of transportation. Despite the new laws, it is still important to be prepared and ride safely. Just because the laws exist does not mean that everyone will follow them. Ride safe and share the roads.

PA Injury Lawyers, What a helpful, practical, timely, useful summary of the recent Pennsylvania bicycle safety law! In particular, it's helpful how you begin with how the bicyclist can improve chances -- particularly with proper protective equipment and road manners -- for safe transit of roads and what daunting injuries can be expected should that not happen.

It's great that the law provides for bicyclists to be where bicycle lanes tend to be: right lane closest to the curb.

Please be assured that I'm a fan of that, but the problem that many encountered during my bicycling days at a huge university was the tendency for litter to lead to flat tires so suddenly that control can be lost without warning.
